R SAY Terms and Conditions

Introduction: R SAY mobile app gives the user the opportunity to give opinion on the businesses, their products and services; political and social issues and trends etc. R SAY users can create their profile and give their opinion on survey polls.

Your views and opinions are valuable to the organisations, many decisions will be made, based upon the feedback you provide. Therefore, in return for your time and effort R SAY will reward you with the free participation in a lucky draw after every survey question you submit.

As a user of R SAY app we will send you survey question which covers a wide variety of topics, ranging from technology, food and beverages and travel, through to social issues both local and national/international that affect you on a daily basis and the frequency of the survey questions can be weekly, fortnightly or monthly as decided by the R SAY team. This variety keeps it interesting for you but also broadens the scope of your influence as your opinion will help organisations shape their future product, service and policy offerings. Influence the world around you while being rewarded with prizes for your time – we can’t say fairer than that.

Your opinions, thoughts and feedback are strictly protected by our usership of R SAY. We take your privacy very seriously, please read it carefully.

This Privacy Policy forms the terms and conditions of usership.

Introduction

R SAY (owned and managed by Gravity77 Pty Ltd) respects and upholds your rights.

This Privacy Policy for R SAY lets you know what personal information of yours we hold, what we do with it, who we will disclose it to and how you can access the personal information we hold about you. You can also find out here how to change inaccurate personal information and how to opt out of receiving communications from us.

What personal information about you does R SAY survey collect and hold?

The information R SAY app collects will include name, email, DOB, location detection by Google and to become a user, we ask that you fill out a registration form in your profile that gathers some other personal and general user information. The information we gather could be used for matching you with the appropriate survey poll. We ask you provide correct details so we can send any prize or rewards owed.

When providing personal information, you do not have the option of remaining anonymous or use a pseudonym to be identified by as in certain circumstances, such as where the survey data itself may potentially allow for identification, and the personal information will be needed to make user profile. Once you have registered on our mobile app (IOS and android) you will be considered an online mobile app R SAY user. This means that we will contact you via app notification from time to time to participate in surveys.

Depending on the nature of the survey we conduct, we may also collect sensitive information from you, including info on racial origin, political opinions, religious beliefs, usership or trade unions, sexual preferences and health information. Sensitive information will only be collected with your prior consent and only if it is directly related to, or reasonably necessary for, the survey we conduct. In most cases any sensitive information collected in our surveys will be in aggregate form that will not personally identify you.

We take reasonable steps to ensure that the information collected is accurate, up to date and complete for our survey requirements. Users have the option to access and update their own personal information in their profile or email us to assist.

How does R SAY Surveys collect and hold your personal information?

R SAY app will generally collect your personal information directly from you in the course of you participating in our survey questions. This information will usually include but is not limited to contact name & email address, DOB, gender and address.

What are the purposes for which R SAY app uses, handles and discloses your personal information?

We will only use and disclose your personal information for the purpose of conducting our survey for providing the data to the relevant third parties for their market research and trend analysis and in accordance with the R SAY Privacy Policy. We will not use or disclose your personally identifiable information for the purpose of advertising, promotions or direct marketing activities. If you decide not to participate in our survey question contest, we will re-contact you for the next survey question via app notification

Who will R SAY app disclose your personal information to?

R SAY app will not disclose any personally identifiable information we collect from you unless we have your express prior consent and will only report the information you provide in an aggregate form that will not personally identify you. We will not disclose any personal information or personally identifiable survey data information to a third party for a purpose other than conducting our survey poll unless we have your expressed prior consent.

In the course of conducting our survey poll we may rely on third party service providers to host or store the data we collect. We will also take reasonable steps to ensure any service providers (and their employees and contractors) comply with the Privacy Act and this Privacy Policy and/or are subject to similar privacy laws.

Openness

You have the right to request access to any personal information we hold about you. You can request this information by contacting the Customer Service Officer at contact@r-say.com. Where we hold information that you are entitled to access, we will respond to your request in a reasonable time and endeavour to provide you with a suitable range of choices as to how access is provided (e.g., emailing or mailing it to you.

If at any time you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it and we will either amend the information or make a record of your comment, as we think appropriate.

Questions and complaints

If you have any questions about this Privacy Policy or believe that we have at any time failed to keep one of our commitments to you to handle your personal information in the manner required by the Privacy Act, the APPs or the Code, then we ask that you contact us immediately using the following contact details:

We will respond and advise whether we agree with your complaint or not. If we do not agree, we will provide reasons. If we do agree, we will advise what (if any) action we consider it appropriate to take in response.

R SAY Mobile app (IOS and android)

When logging in the R SAY app, the site server makes a record of the visit and logs the following information for statistical and administrative purposes:

the user's server address - to consider the users who use the app regularly and tailor the app to their interests and requirements;
the date and time of the visit to the app - this is important for identifying the app’s busy times and ensuring maintenance on the site is conducted outside these periods;
profile accessed and pictures uploaded in the personal album - this indicates to R SAY which icons are most important to users and also helps identify important information that may be difficult to find; picture uploading in the profile will be allowed and approved if it is has inappropriate content in any form or pornography or promotes any anti law activities
duration of the visit - this indicates to us how interesting and informative the R SAY app is to users

R SAY & Cookies

A cookie is a piece of information that a mobile app sends to your mobile when you access information at that app. R SAY may use both session and tracking cookies Upon closing your app the session cookie set by this app is destroyed and no Personal Information is maintained which might identify you should you visit our app at a later date. We also use cookies and anonymous identifiers, when you interact online such as advertising services that may appear on other sites.

Please note, no personal identified information is used in the creation of segments or matched back to cookie information collected. (including PII related to the user's mobile phone device). Our cookies have no sensitive segments or segments targeted at children under 13 years of age. Our cookies have no packet sniffing in the collection of behavioural data.

We will not associate cookies, web beacons, or other tracking mechanisms with personally- identifiable information (PII) for any purpose or with precise user location for behaviour targeting without your consent and have knowingly and expressly opted in. (For purposes of this document, PII and precise user location does not include IP addresses.)

R SAY does not use locally shared object (LSO) technologies (including but not limited to flash cookies, browser helper objects, or HTML5 local Storage)

R SAY does not use collected data from cookies for re-targeting, interest category categorization, or syndication to other parties

We use information collected from cookies and other technologies, like pixel tags, to improve your user experience and the overall quality of our services. Please note we do not combine personal information you have provided at registration with information collected in our cookies.

Opting out of cookies: We understand our users have different privacy concerns and you may also set your browser to block all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us.

However, it’s important to remember our services may not function properly if your cookies are disabled and as a result it will limit the survey participation we can offer. Accepting this privacy policy is taken as accepting the use of these cookies.

Security of Information

R SAY will take reasonable steps to protect your personally identifiable information as you transmit your information from your mobile phone to our app and to protect such information from loss, misuse, and unauthorised access, use, modification, disclosure, alteration, or destruction.

We are committed to ensuring your information is secure. We've put in place suitable physical, electronic and managerial procedures to reasonably secure any information collected from you from misuse, interference or loss, and in order to prevent unauthorised access, modification or disclosure to that information.

However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. In particular, e-mail sent to or from the R SAY may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Participation in survey question

Participation in our surveys contest is voluntary and free. If you do not wish to take part in any future surveys from R SAY, simply do not answer the question for the survey poll in the Your opinion icon of the R SAY app.

Miscellaneous

In this policy "personal information" has the same meaning as under the Privacy Act. This policy is effective from 04 Feb 2017. We may change this policy from time to time. Although we intend to observe this Privacy Policy at all times, it is not legally binding on R SAY in any way. From time to time we may regard it as necessary or desirable to act outside the policy.

Important Note to users:

R SAY users agree to abide by the following terms of usership:

R SAY users, after downloading the app will be asked to agree to the Terms and Conditions and Privacy Policy of this app and once the user agrees to it, the user will not be asked to agree to the terms and conditions each time the user participates in the survey question polls. It is the responsibility of the user to make sure that the user regularly reads the updated T&C and Privacy policy of the R SAY app.
R SAY users have to read & agree to Privacy policy and Incentive/Prize policy otherwise will not be allowed to create an account with the app
R SAY users can use only one mobile phone number and email address/mailing address and same user should never sign-up for more than one R SAY account.
R SAY usership is not limited to one account per household/family. All family members in one household can have independent R SAY account using their mobile phone numbers.
R SAY users must always provide details that are truthful and accurate and must never intentionally provide misleading or false information.
R SAY users agree to take a considered approach, not rush through surveys and not provide misleading or false information.
R SAY users must not act fraudulently in attempt to gain survey prizes
R SAY users agree that once the survey is completed & information collected from the survey data in an aggregate form can be shared or distributed with third parties for their marketing research analysis
R SAY users may be removed from the app if they breach usership terms and conditions or they indulge in any indecent chat, behavior, abusive/violent language, promoting any anti law activities or pornographic content in the app
R SAY users can also be removed from the usership if they post pornographic pictures or anti law content in their album or status
R SAY users will be sent a notification on their app if they win and subsequently an email confirmation will be sent as well. The user has to fill the details requested in the email including their home address and send that email back to R SAY team at contact@r-say.com. If no email with their details is sent to R SAY, no prizes will be sent to the user
R SAY user has to ensure to provide the correct address and details in order to receive the prizes from the draw if the user is a winner. Under any circumstance if the address and details provided are incorrect R SAY claims no responsibility for the user not receiving the prize
R SAY user will have to provide their photo ID such as passport/drivers licence, when the parcel is mailed to the address and only the user can claim the prize. If the user is not available, the courier company will make three attempts to deliver the prize and if the attempts are unsuccessful the user will not be eligible to claim the prize anymore unless the R SAY team agrees to it.
Photos of the prizes shown in the app are for illustration purposes only, they can differ in colour and models and maybe different in reality.
Users have to ensure that they provide their correct information while they make their profile such as their name, gender, DOB, email address if this information is not correct and the users wins a prize, no prize will be given if the information is inaccurate. Only user can claim the prize.
Prizes are not redeemable for cash.
R SAY will decide to post the opinion poll question to the users of a specific age, gender, location etc. based on the target market.

Incentive Policy

The R SAY incentive/prize program is owned by Gravity77 Pty Ltd. If you register as a user on the R SAY app you agree to be bound by this incentive/prize policy.

Survey Participation and winning prizes

R SAY users will be sent app notifications for invitations to participate in survey. Participation in any app initiated survey is voluntary and free. For every survey you participate in, you will receive a chance to participate in the free lucky draw and the user will be issued a ticket number and the auto generated system will randomly pick the users as the winners for the designated draw number, date and time. The value of the rewards the winner will receive will vary from question to question and the number of users participating in the survey poll at the time. For each survey question posted, the prize icon in the app will include the information on all the prizes being offered for that particular draw and its details.

Users will not receive participation in the lucky draw to win any prizes if they start a survey but fail to submit it. At the end of a survey you will be randomly issued a ticket number for the lucky draw. Users must enter their correct address details to receive their prizes. R SAY will not be responsible for any delay in the delivery of prizes due to incorrect address details provided by the user.

We ask you keep a copy of the email sent by R SAY team advising the user if he/she has won the prize, handy so you can be delivered the prizes owed to you. R SAY is not responsible for users who enter incorrect address details and are not subsequently awarded their prizes if they win in the draw.

Prizes will be awarded within three weeks after the lucky draw is drawn. To view the prizes please click on the prize icon and to view if you have won just click on the lucky draw icon and then click on view winners. You can also see last week or month winners by the draw numbers and dates on the R SAY website.

Users are responsible for notifying R SAY if they believe prizes have not been properly awarded to them. If R SAY is aware of any errors or technical problems that have denied you from participating in the survey question we might contact you to get the details of the error if any however R SAY will not be responsible for any internet failure, technical errors or app crash during contest which might disadvantage any user from participating in the survey poll and further in the lucky draw. Prizes cannot be transferred to other persons or users.

Note: The prizes displayed on the app are for reference and illustration purpose only. R SAY acknowledges that the promotion in the form of prizes displayed on the app are in no way sponsored, endorsed or administered by, or associated with any of the brands displayed in the photos of the prizes.

Claiming your prizes

Any prizes given to you in the form of Gift Cards and movie tickets will be posted to you and will be received by you within 28 days of redemption. R SAY will usually send you an email asking you to verify your address details.

Other prizes will be mailed to the user at the provided address, by a reliable courier company contracted by R SAY and the user has to ensure to provide their photo ID such as drivers licence/passport, at the time of receiving the parcel and the parcel will only be delivered to the user who is the winner. No family member/friend/agent can claim the prize on behalf of the user. Courier company will make three attempts to deliver the parcel prize and if the attempts are unsuccessful the user will not be eligible to claim the prize anymore unless the R SAY team agrees to it.

Survey completion and fraudulent activity

When answering the survey question we expect the users to answer surveys honestly and not answer without consideration to responses. We may do data checks to determine any issues with survey completion and valid prizes. User may be forcibly removed if we detect fraudulent behaviour.

Prizes & termination of your account with R SAY app

If you no longer wish to be a user of the R SAY app simply delete your account. Users who delete their account with the R SAY app will not be contacted by R SAY in relation to any prizes they have not claimed. Deleting the R SAY account will result in cancellation of all the prizes but it is the responsibility of the user to contact us in regard to claiming their prize if they have won in the lucky draw. Standard policies of redeeming your prizes apply.

R SAY account and fraudulent activity

R SAY app account is limited to one account per person via registering through their mobile number. R SAY usership is not limited to one account per household. All family members in one household can have independent R SAY account using their mobile phone numbers and personal details

R SAY conducts regular data checks that may include reviews on data quality, survey completion time, users with multiple accounts and inappropriate fraudulent activity. Users may be forcibly removed if we detect fraudulent behaviour.

We may change this Notice

R SAY may, from time to time, review and update this incentive/prize policy to take account of new laws and technology and changes to company operations. Please visit the terms and conditions and privacy policy periodically, to check for updates. Your continued participation in our survey questions after the effective date of any changes will constitute your acceptance of all of the changes.

TERMS & CONDITIONS OF ENTRY

Method of Entry:

Users will be invited via notification on their phone to participate in our current survey question and then the user needs to answer the relevant survey question to be able to participate in the free lucky draw prize. Prizes will vary from each survey question posted and users will be informed of the draw number date and time of the lucky draw and the prizes they could win after completing each survey question, prior to commencement, via the icons Lucky Draw and Prizes in the R SAY app. Users will have one entry only per every lucky draw.

The prize draw will be drawn electronically using an approved random number generating system. The winners will be notified within a few minutes of the draw on the app via the lucky draw icon and view winners sub icon on the app.

In accordance with Gravity77 Pty Ltd privacy policy only the names of prize winners will be published.
